This website, cromatcg.com (the "Site"), is owned and operated by Croma TCG, a retail business organized and operating under the laws of the State of Utah, United States of America. Croma TCG operates two physical retail locations in Salt Lake City, Utah and Lehi, Utah, as well as an online store accessible through this Site.

All inquiries regarding the operation of this Site or Croma TCG's retail business should be directed to the contact information provided in Section 14 of this Notice.

2. Intellectual Property & Third-Party Trademarks

Croma TCG is an authorized retailer of trading card game products. All product names, card names, set names, images, artwork, logos, symbols, and trademarks displayed on this Site in connection with third-party products are the exclusive intellectual property of their respective owners. Croma TCG claims no ownership, affiliation, endorsement, or sponsorship with respect to any of the following brands or their parent companies:

• Magic: The Gathering — Owned by Wizards of the Coast LLC, a subsidiary of Hasbro, Inc.
• One Piece Card Game — Owned by Eiichiro Oda / Shueisha Inc. / Toei Animation; licensed and published by Bandai Co., Ltd.
• Riftbound — Owned by its respective publisher and licensor.
• Gundam Card Game — Owned by Sotsu Co., Ltd. and Sunrise Inc.; published by Bandai Co., Ltd.
• Disney Lorcana — Owned by The Walt Disney Company; published by Ravensburger AG.
• All other trading card game brands, products, and associated intellectual property referenced on this Site remain the sole property of their respective owners.

Use of any third-party trademark, logo, or product image on this Site is solely for the purpose of identifying products available for retail sale and does not imply any affiliation with, authorization by, endorsement by, or sponsorship from the trademark owner beyond Croma TCG's status as an authorized reseller. No license or right to use any such intellectual property is granted by Croma TCG.

The Croma TCG name, logo, and any original content produced by Croma TCG are the proprietary property of Croma TCG and may not be copied, reproduced, distributed, or used without prior written consent.

3. Product Availability & Pricing

All product listings, prices, and availability information displayed on this Site are subject to change at any time without prior notice. Croma TCG makes no guarantee that any product displayed on the Site is available for purchase at the time of your order or in-store visit.

In the event of a pricing error — whether due to typographical mistake, system error, or any other cause — Croma TCG reserves the right to cancel or refuse any order placed at the incorrect price, even if the order has been confirmed. You will be notified of such cancellation and offered a refund of any amount charged.

Croma TCG does not offer price matching with any competitor, online marketplace, or third-party seller. Posted prices are final unless a promotional discount is expressly applied at checkout or at the point of sale.

Limited-release, pre-order, and allocated products are subject to strict availability constraints imposed by publishers and distributors. Placement of an order or pre-order does not constitute a guarantee of fulfillment. In the event Croma TCG is unable to fulfill a pre-order, affected customers will receive a full refund of any amounts paid.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CROMA TCG, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

• Your access to or use of (or inability to access or use) this Site;
• Any errors, omissions, inaccuracies, or misleading information in product descriptions, specifications, or pricing;
• Any transaction conducted through or facilitated by this Site;
• Unauthorized access to or alteration of your data or transmissions;

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, Croma TCG's liability shall be limited to the maximum extent permitted by law. In no event shall Croma TCG's total cumulative liability to you for any cause whatsoever exceed the amount you paid to Croma TCG in the ninety (90) days preceding the event giving rise to the claim.

6. User Conduct

By using this Site or participating in any Croma TCG event or visiting our retail locations, you agree not to engage in any of the following prohibited activities:

• Using this Site for any unlawful purpose or in violation of any applicable local, state, federal, or international law;
• Attempting to gain unauthorized access to any portion of the Site, server, or database;
• Transmitting any unsolicited or unauthorized advertising, spam, or promotional material;

Croma TCG reserves the right, at its sole discretion, to refuse service, revoke access to this Site, or remove any person from its premises or events for violation of these standards or for any other reason deemed appropriate by management.

This Legal Notice does not create any additional or expanded return rights beyond those set forth in the current Return & Refund Policy. Certain product categories — including but not limited to opened sealed product, tournament-legal singles, and special-order items — may be subject to additional restrictions or be ineligible for return. Croma TCG reserves the right to refuse returns or refunds that do not comply with its stated policy, are suspected to involve fraud, or involve products that have been altered, damaged, or rendered unsaleable after purchase.

9. Event Participation & Assumption of Risk

Croma TCG regularly hosts in-store events, tournaments, leagues, game nights, and other activities at its Salt Lake City and Lehi locations (collectively, "Events"). By registering for, entering, or participating in any Event, you expressly acknowledge and agree to the following:

Assumption of Risk. Participation in Events is voluntary. You assume all risks associated with participation, including but not limited to: physical injury, property damage, theft, loss or damage to trading cards or other personal property, and any other harm arising from your presence at the Event venue.

Release of Liability. To the maximum extent permitted by applicable law, you hereby release, discharge, and hold harmless Croma TCG and its owners, employees, agents, and volunteers from any and all claims, demands, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your participation in any Event, including claims for personal injury, property damage, or loss of cards or personal belongings.

Card & Property Responsibility. Croma TCG is not responsible for trading cards, accessories, personal electronics, or any other personal property brought to or left at an Event. Participants are solely responsible for the safekeeping of their own property. Croma TCG does not assume liability for lost, stolen, damaged, or misplaced cards or personal items.

Minors. Participants under the age of 18 must have a parent or legal guardian review and agree to these terms on their behalf. By allowing a minor to participate in a Croma TCG Event, the parent or guardian accepts these terms and assumes all risks described herein.

Conduct. All Event participants are expected to conduct themselves in accordance with the applicable tournament rules published by the relevant card game publisher, as well as Croma TCG's in-store conduct standards. Croma TCG reserves the right to disqualify or remove any participant at its discretion for any violation of these standards.

10. Governing Law & Dispute Resolution

This Legal Notice and any dispute arising out of or relating to your use of this Site, any purchase from Croma TCG, or your participation in any Croma TCG Event shall be governed by and construed in accordance with the laws of the State of Utah, United States of America, without regard to its conflict of law provisions.

Any legal action or proceeding arising under or related to this Notice shall be brought exclusively in the state or federal courts located in Utah, and you hereby irrevocably consent to personal jurisdiction and venue in such courts.

If any provision of this Legal Notice is found to be invalid, unlawful, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

11. Copyright Infringement (DMCA)

Croma TCG respects the intellectual property rights of others and expects users of this Site to do the same.
